But there’s one critical warning they need to heed: the inclusion of blood, even fake blood, in videos or images on the platform is not permitted. The consequences of violating this policy can be significant, potentially leading to account suspension or even legal repercussions.

But why does this restriction exist, especially when it seems tied to something as harmless as a Halloween costume? The answer lies not in the policies of OnlyFans itself but in a broader legal context rooted in U.S. law.

The Legal Basis: Obscenity Laws and the Miller Test

The prohibition of content involving blood on OnlyFans is tied to federal obscenity laws. These laws distinguish between legal pornography and what is considered “obscene,” a category of content that is not protected under the First Amendment and can be subject to legal regulation. The definition of obscenity in the United States is based on a legal standard known as the Miller test, which the Supreme Court established in the landmark 1973 case Miller v. California.

According to the Miller test, material is considered obscene if:

  1. The average person, using contemporary community standards, finds that the content appeals to prurient interests (an excessive focus on sexual matters).
  2. The content depicts or describes, in a patently offensive way, sexual conduct or excretory functions as defined by applicable state law.
  3. The content, taken as a whole, lacks serious literary, artistic, political, or scientific value.

The aim of this definition is to protect free speech while regulating material deemed harmful or inappropriate for public consumption. As a result, platforms like OnlyFans, which operate under U.S. jurisdiction, must adhere to these federal standards, even if their primary focus is on adult entertainment.

Why Blood Is Considered Problematic

While some users might argue that depictions of blood could be used artistically or in the spirit of Halloween, the broad application of the obscenity standard means that it’s simply safer for OnlyFans to ban such imagery outright. Other platforms also adopt similar policies, emphasizing that this restriction is not unique to OnlyFans but a legal requirement applicable across the digital landscape.

As Halloween festivities inspire creative costumes and themes, OnlyFans users should exercise caution and avoid using blood—real or fake—in their content. The rules surrounding obscenity may seem complex, but the legal stakes are clear. OnlyFans, like other platforms, is simply following federal regulations, and content creators must do the same to avoid severe consequences.
